Among the issues of a second Joe Biden presidential election are his age and his current able Vice President, Kamala Harris.  There is a single solution to address both issues and answer the outcome question as to whether the United States will continue as a democracy or become an autocracy?

In the interest of securing a second term for President Biden, I suggest the capable and talented Kamala Harris not accept the 2024 Vice Presidential candidacy.  There will be ample future opportunities for Ms. Harris to continue her political career.  President Biden should choose as his second term Vice President Barack Obama.

The XXII Amendment does not prohibit Barack Obama from running as a 2024 Vice Presidential candidate.

GOVERNANCE DEMENTIA, A VIRUS…

Governance dementia is a term to describe a newly identified virus that causes elected officials to suffer a loss of memory with respect to sworn commitments contained in their oath of office.  Some common indicators of governance dementia are using their position for personal gain, serving special interests, making decisions against the people, playing political gamesmanship, and ignoring their oath of office.

There are several means to prevent or treat governance dementia. Some of the possible approaches include periodic cognitive reviews, ethics training, term limits, anti-corruption laws, complete transparency and deeper accountability just to mention a few. 

However, there is another approach and that is to have elected officials recite an “oath acknowledgement statement” at every gathering where the pledge of allegiance and/or a prayer is performed. This oath pledge could remind them of their oath commitment to uphold the principles of a democratic republic and good responsive governance. The oath pledge could be something like the following:

“I, [name], do solemnly swear at this assembly and before my GOD, the people of this great nation and those assembled here that I will  bear true faith and allegiance to fulfill my responsibilities sworn to in my office oath, and to be faithful to the principles of democracy, equality, liberty and freedom delineated in the Constitution and the laws of the United States.” 

Governance dementia is a serious problem that has an impact on every citizen. This oath pledge would remind officials of their commitment to uphold their oaths and the principles of democracy and responsible governance.  Those who chose not to take an oath pledge should be considered as not worthy to remain in their position.

After Labor Day how many of us citizens will be celebrating September 17th, Constitution Day? That’s the day the Constitution’s final signature was achieved establishing our democratic republic. Why not change Constitution Day observance to the first Tuesday in November? The September 17th date is symbolic anyway. Doing so would make Constitution Day coincide with the biennial federal elections and we could celebrate both events as a national holiday.

Just think, what better way to reflect on the importance of our Constitution than to exercise the right to vote on the same holiday, free of work pressure. This simple action would encourage greater voter turnout and an increased awareness of the elements of the Constitution.

The synergism of these two important events occurring on the same day would serve as a reminder of the fundamental values that our nation was founded upon, and the rights, freedoms, and liberty we as citizens enjoy.

Members of Congress can set into motion the opportunity for citizens of this great country to honor both its Constitutional foundations and the ability to exercise those freedoms by combining these two events into one and being able to vote without constraints on the same day.

It is a simple step for Congress to create this combined event honoring democracy! If you concur, let your Congressional representatives know!

This supermajority conservative “hand picked” Federalist Society set of justices will serve out their term as lifetime appointees since they were appointed under “lifetime term” legislation.  

Just think of the damage to our freedoms and how much this majority can “soil” our Constitution, the rule of law, judicial ethics, and our democracy while serving out their lifetime appointments.

There is a solution and that is to have the next congressional session dilute the super majority by revising the hundred fifty year old 1869 Judiciary Act.  They can increase the Supreme Court to 13 members, require a 2/3 vote in decisions (OK 60%), and limit terms to 25 years.  

Revising the Act could also include an ethics code, public transparency and any other updating to bring the Justice system into the 21st century.  

All we need to do is vote for a Congress that works for the American public.

The 2024 Presidential election presents a possibility that third party candidates may play a significant role in determining the next President of the United States.  According to the Twelfth Amendment of the Constitution, if no presidential candidate receives 50%+1 of the Electoral College Electors vote, each state in the House of Representatives has one vote which can be voted for one of the candidates.  When a candidate receives 50%+1 of the House’s state votes, the House of Representatives will have determined the next President of the United States.  This was the case in the election of 1824.

2024 may recreate that situation which occurred in the 1824 election where multiple presidential candidates divided the electoral votes so that  no candidate met the requirement of a 50%+1 vote majority to become President.  The selection of the President then became the responsibility of the House of Representatives in accordance with the Constitution’s Twelfth Amendment. Each state of the House of Representatives then voted their single vote choice until a 50%+1 majority vote was obtained for one of the eligible candidates.  In the 1824 election the House selected as President a candidate who was neither the choice of the popular vote or had received the highest electoral votes.

The effect of well funded and popular third party candidates can play havoc with the Electoral College vote system, especially in thin margin key states.  It is possible that no candidate will receive the 50%+1 of the electoral votes and the president will be determined by 26 state votes of the House of Representatives.  This historic election will determine whether the future of the United States will still be  a democracy or become an autocracy and who makes that determination.  Only time and you the voters will tell.

The six conservative members of the United States Supreme Court have now formed and implemented the Nuremberg Sextet, a group specializing in “Gleichschaltung”.  Gleichschaltung is a unique German term that prescribes the complete conversion of a governmental system and its society into a totally different ideological system.

Yes, thanks to the SCOTUS Sextet we are well on our way to White Christian Nationalization of the United States.  Decades ago it was called “Nazification” and we may not be too far from turning that corner today.  We already have seen corporations empowered by Citizens United, book banning, personal health choices denied, voting rights impaired, affirmative action eliminated, equal rights denied.  These are just a few of the rights enshrined in the Constitution.  Is habeas corpus, free speech, press, assembly, or even the Constitution itself next?  In Germany of the thirties it was the Jews and the Communists.  In America today it is people of color, Jews and the LBGTQ community.

The future of this Country is in the voter’s hands.  The 2024 election may be the last opportunity to change the Supreme Court.  There is a bill in Senate Committee, S1141 Judiciary Act of 2021, which changes the size and thus the composition of the Supreme Court.  Changing the Congress from its Clown Car politicial composition will help move that bill through the legislative process.

There is a little-known political stratagem which is a major objective of politicians and political entities.  That objective is known as “political capital”.  Political capital is an ambiguous term that defines an illusive political benefit derived by exploitation of a particular governmental situation, problem, action, or crisis.  Anyone may be an intentional or unintentional co-opted participant.  Participants vary from an individual elected official, a political entity, voters, industries, a selected beneficiary to unsuspecting members of the public.

As the process plays out there are winners and losers.  Winners are those who achieve an increment of “political capital” and the losers lose whatever is in play.  Optimizing capital benefits is frequently achieved by manipulating a normal problem into a major crisis.  Creating that crisis establishes the objectives and tactics to maximize benefits and defines who wins, who loses, and who benefits.

Why play this political capital game?   Simply for power.  The rewards encompasses accumulating power chips; playing to the base; capturing media attention; showcasing political skills; building constituent support; embarrassing opposition; benefiting specific business sectors; modifying  democracy; fundraising, etc., etc.  Political capital is derived from support, opposition, failure, change, delay, or any other result which has a political implication.   If the perpetrator of the play is successful, it is possible that the win can be shared among other participants.

Understanding the “political capital” objective provides an insight into why many issues which begin as a simple problem are purposely manipulated into a valued crisis.  There are many historical events that illustrate the political capital opportunity:  Washington’s during his presidency, Lincoln’s co-opting the opposition into his cabinet, Roosevelt’s threat of packing the Supreme Court, Johnson’s Civil Rights legislation, Bush’s 9/11, et al.  Some current  “problem to crisis” issues that are ripe for a political capital play are assault weapons, abortions, LBGTQ, judicial decisions, social security reform, taxes, budget, immigration, voting rights, congressional investigations, and of course, the crisis ‘du jour’, debt limits.

THE BOTTOM LINE: 

THERE IS NO VALUE IN SOLVING A PROBLEM, WHEN SUBSTANTIAL POLITICAL CAPITAL CAN BE EXPLOITED AND REALIZED  BY A CRISIS!!!
